West Virginia Rule

On March 16, 2017, the West Virginia Department of the Environment (DEP) published an Interpretive Amendment to an Existing Rule titled "Disposal of Completion Waste." It pertains to materials and practices generated at horizontal well sites (frac sites).  

The rule defines completion wastes and includes natural radioactivity in the definition. It provides direction on the solid waste landfill permit process and establishes:

  • Radiation monitoring requirements for solid waste landfills,
  • Waste profile requirements (including acceptable concentrations of radium), and
  • The need for disposal facilities accepting this waste to prepare and submit Radiation Monitoring Plans.
